W.Va. court revives fired police chief’s lawsuit

CHARLESTON — The West Virginia Supreme Court has revived a former police chief’s lawsuit claiming he was unjustly fired.

In 2012, a Fayette County judge ruled that the city of Montgomery and its mayor were immune from former chief Jackie Brown’s lawsuit. The judge also rejected Brown’s claim that he was entitled to a hearing before being fired.

In Thursday’s ruling, the Supreme Court agreed with the judge on the hearing issue but said the city and mayor aren’t immune from the lawsuit. The case was sent back to Fayette Circuit Court.

According to the Charleston Gazette, Brown claims Mayor James Higgins Jr. fired him for refusing to install a GPS tracking device on the cruiser driven by a police officer who had filed a civil rights lawsuit against the city.
