Fairmont expands obscenities ordinance

WASHINGTON —  Fairmont has added computer and electronic communication devices to an ordinance that prohibited harassment by telephone.

The revised obscenities ordinance mirrors a state law adopted in 2002.

City manager Jay Rogers tells the Times West Virginian that making the state’s language part of the municipal code will give city police officers more flexibility.

He says city police recently handled a case in which an individual made threatening and harassing statements to another person by computer. The individual faced other city charges but officers had to take the obscenities charges to magistrate court.

Rogers says officers now can take such charges to municipal court.

He says officers will work with prosecutors to determine which court is most appropriate.

City Council approved the ordinance’s expansion last week.
