The Logan County Sheriff’s Department and a deputy accused of beating a suspect in 2011 have denied any wrongdoing.
Deputy James Brown acknowledges he used pepper spray to subdue Charles Allen Simpkins and transported him to a hospital for treatment.
But in his recent response to a lawsuit in U.S. District Court, Brown denies that he took a detour and beat Simpkins behind a school near Accoville.
Brown’s motion asks the court to dismiss the lawsuit.
Simpkins says his civil rights were violated when he was kicked and punched repeatedly with weighted or reinforced black leather gloves.
He says the beating occurred while he was handcuffed and only stopped when a second deputy intervened.
Simpkins was treated for a broken nose, and bruises on his face, scalp, ribs and ankle.
