Petition seeks removal of Albemarle Co. supervisor

CHARLOTTESVILLE, Va. — An Albemarle County resident has submitted a petition to circuit court seeking the removal of a county supervisor who pleaded guilty to sexual battery.

Media outlets report that Earl Smith of Keene gave the petition to the circuit clerk’s office on Tuesday. Albemarle County Circuit Court Judge Cheryl Higgins has 10 days to have the signatures on the petition verified. A hearing date will be set if enough signatures are verified.

Smith says he collected 584 signatures on the petition. He needed 372 signatures to meet the state’s requirement of 10 percent of the number of voters who cast ballots in the election for Supervisor Christopher Dumler’s seat.

Dumler pleaded guilty to misdemeanor sexual battery in January. He has said he won’t resign.

He declined to comment on Smith’s petition.
