Magistrate Cox indicted by McDowell County grand jury

WELCH — Grand jury indictments released Thursday in McDowell County included the name of a local magistrate.

Magistrate Steve L. Cox has been indicted by the McDowell County grand jury on two counts of alteration of a public record by an officer, according to an indictments list released by Circuit Court Judge Rudolph J. Murensky II.

An administrative order from the Supreme Court of Appeals of West Virginia dated June 18 in the case of Kevin A. Wade vs. Steve L. Cox, Magistrate of McDowell County calls for impaneling a three-judge court to hear the case.

The order called for Judge Omar Aboulhosn of the Ninth Judicial Circuit in Mercer county, and Senior Status Judges John L. Cummings and Charles M. Vickers to convene on July 21 in McDowell County Circuit Court to hear the case.

After telephone calls from the Bluefield Daily Telegraph, Prosecuting Attorney Ed Kornish left a message with his administrative assistants stating that he had no comment about the case.

According to the administrative order signed by Chief Justice Robin Jean Davis, the hearing could be extended beyond July 21 until the case is concluded. The three judges could set an alternate date and time for the hearing.

The text of the indictment was not available Thursday, and neither Cox nor Wade could be contacted for comment.
