Prelim continued for man charged with sex crimes

GREEN VALLEY — A Mercer County man remained at Southern Regional Jail on Friday on charges that he sexually assaulted and abused a mentally handicapped adult female.

David Neil Martin, 44, of Green Valley, was scheduled to appear before a Mercer County magistrate on Wednesday for a preliminary hearing on charges including four counts of sexual assault in the third degree and four counts of sexual abuse in the second degree, according to Cpl. S.A. Sommers, of the West Virginia Internet Crimes Against Children Task Force and the Mercer County Sheriff’s Department.

“Cpl. J.C. Long of the Princeton Detachment of the West Virginia State Police learned about the new charges when he arrested Mr. Martin on failing to register as a sex offender,” Sommers said. “He also had prior arrests for failing to register as a sex offender.

“He was an agitator in this situation,” Sommers said. “He took advantage of the female.” Sommers said that he made the arrest “about two weeks ago.”

Sommers said that Martin told the court on Wednesday that he was looking to hire a lawyer to represent him. “The magistrate court continued his preliminary hearing,” Sommers said.

Martin is being held at Southern Regional Jail as a pre-trial felon on a $5,000 bond.

According to Long, Martin had just gotten off probation for one of his failure to register as a sex offender charges on April 28.
