Three indicted on first-degree murder charges in Mercer

PRINCETON — Three people have been indicted by the Mercer County grand jury on charges of first-degree murder in connection with the execution-style shooting of a Summers County man.

The grand jury indicted 44-year-old Oscar Combs Sr., 21-year-old Oscar Combs Jr., and 38-year-old Linda Combs on charges of first-degree murder, robbery and conspiracy in connection with the April 2011 slaying of James “Bo” Butler of Summers County, according to Mercer County Prosecuting Attorney Scott Ash.

Butler was shot execution-style in the back of his head along Route 10 at Herndon Mountain in Mercer County, according to an earlier report by Cpl. A.S. Reed of the West Virginia State Police. The alleged motive for the shooting was robbery.

Butler’s body was discovered several weeks after the murder on Crumpler Road in Wyoming County, several miles from the Mercer-Wyoming line. Butler was known to regularly commute through Mercer County.

Ash said Oscar Combs Sr., Oscar Combs Jr. and Linda Combs are all scheduled to be arraigned on the indictment charges June 23.

In a second unrelated case, Ash said the grand jurors indicted Morrisettie Leggett, 32, of Bluefield, on a charge of first-degree murder in connection with the shooting death of David Bailey, 35, of Princeton, in December 2013 at Club Maximus near Princeton.

Deputies with the Mercer County Sheriff’s Department were dispatched to the nightclub’s parking lot on Dec. 9, 2013, in response to a report of a shooting.

During an earlier hearing in the case, Detective Cpl. L.B. Murphy of the Mercer County Sheriff’s Department testified that Leggett was the DJ at Club Maximus the night of the incident. A fight happened between Leggett and Bailey over a domestic issue that then led to the parking lot. Leggett allegedly pulled out a .38-caliber handgun from his sweatshirt pocket and shot at Bailey five times.

Ash said Leggett will be arraigned on the indictment charges June 23.
