Child porn case plea continued

TAZEWELL, Va. — Prior to the 9 a.m. start of Tazewell Circuit Court on Monday, defense counsel for William Charles Rutherford requested a continuance for his client’s plea hearing.

Rutherford, 58, a Bluefield, Va., businessman, was named in a May 7, sealed indictment returned by a Tazewell County grand jury charging him with reproducing and transmitting child pornography, according to information available online through the Virginia Courts Case Information System.

Detective Sgt. Mike Brown and Detective Scott Stiltner of the Tazewell County Sheriff’s Office’s Internet Crimes Against Children Task Force investigated the case at the request of the Bluefield, Va., Police Department.

“They have the expertise for conducting this kind of an investigation,” Lt. Pete Beavers of the Bluefield, Va., Police Department said. “They did the investigation, but we made the arrest.”

Following the indictment, the court scheduled trial dates on May 21, according to the Virginia Courts Case Information System. The parties were in court on July 2, for a pre-trial motions hearing.

Rutherford was scheduled to appear Monday at the plea hearing before Tazewell County Circuit Court Judge Jack S. “Chip” Hurley Jr. Bluefield attorney James Dudley is representing the defendant and Tazewell County Commonwealth’s Attorney Dennis Lee is representing the state.

The defense requested a continuance on the plea hearing until Nov. 19. The court approved that request.
