AFTERNOON UPDATE — Judge denies motion to dismiss sex registry violation indictment

BLUEFIELD — A federal indictment against a Mercer County man charged with failing to register as a sex offender will continue after a federal judge denied the defendant’s motion to dismiss the charges.
Keith Eugene Nelson, 45, of Bluefield asked the court to dismiss the June 9 indictment against him, but U.S. District Judge Thomas E. Johnston of the Southern District of West Virginia found the grand jury had reason to return the indictment and denied the defendant’s motion.
Nelson was previously living in Illinois, but from early February until his arrest on April 2, he was apparently splitting his time between living in Bluefield and staying in Bland County on the Appalachian Trail, court documents reveal.
