West Virginia man not guilty of making terrorist threat

CHARLESTON — A jury has found a Kanawha County man not guilty of charges that he made a terroristic threat.

Media outlets report that the Kanawha County Circuit Court jury issued its verdict Wednesday morning shortly after it reconvened.

Shawn Foglesong of Sissonville was arrested in September 2012 after he told a counselor at Highland Hospital that he was scared he might wear a mask around Halloween and open fire at a high school football game.

Defense attorney John Sullivan told the jury in his closing argument Tuesday that Foglesong was trying to get better.

“It’s the exact opposite of trying to threaten people and make them afraid,” Sullivan said. “To make sure you are not going to be a danger to yourself or others.”

Kanawha County Assistant Prosecutor Michelle Drummond said the law only requires that a threat is made. She said it is not necessary that a person intends to commit the act, or that a person commits the act.
