Click testifies that alibi is sex tape

MCDOWELL — The defendant Earl Click took the stand on his own behalf Tuesday morning and told a different version of what happened on the day War Mayor Thomas Hatcher died compared to other testimonies by state witnesses.

Click testified that the absence from his apartment in the early morning hours of July 17, 2012, that his uncle Roy Harding had testified about was due to he (Click) making a sex tape with Misty Laws.

Click’s mother, Tammy Shortridge testified that when she asked Laws for the tape, Laws destroyed it in front of her. The state subpoenaed Laws to testify in the case, but she refused early in the trial because of two alleged death threats she said she had received, according to McDowell County prosecuting attorney Ed Kornish.

The trial will resume Wednesday morning at 9:30 a.m.
